  • Regional & Artisanal Craft: Vaniksha Organics specializes in authentic regional foods, heirloom delicacies, roasted seeds, and clean-label pantry provisions. Because many of our products are handcrafted or prepared in small batches using traditional methods, slight natural variations in shape, texture, color, and aroma may occur across batches. These natural variations are inherent to traditional culinary craft and do not constitute a product defect.

  • Display Accuracy: We make every effort to display the colors, textures, and packaging of our products as accurately as possible. However, the visual appearance may vary depending on the display settings and color profile of your screen or device.

  • Allergen & Nutritional Information: Detailed ingredient profiles and nutritional declarations are provided on our product packaging in accordance with the Food Safety and Standards Authority of India (FSSAI) guidelines. It is the customer's sole responsibility to review ingredient lists prior to purchase or consumption if you have known food sensitivities or allergies (including but not limited to wheat/gluten, nuts, dairy/ghee, and seeds).

  • Storage Instructions: Customers must adhere to the specific storage directions printed on the packaging (e.g., storing in a cool, dry place, away from direct sunlight, or transferring into airtight containers upon opening) to maintain freshness, crunch, and shelf life.

  • Product Changes & Availability: All product descriptions, formulations, and prices are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the sales or quantities of any products to any person, household, geographic region, or jurisdiction on a case-by-case basis.

SECTION 3 - ORDERS, ACCEPTANCE & USAGE

When you place an order on the Platform, you are making an offer to purchase. Vaniksha Organics reserves the right to accept, decline, or limit order quantities at any time after receipt of the order for reasons including inventory unavailability, pricing or description errors caused by technical anomalies, or suspected unauthorized, fraudulent, or non-authorized reseller transactions.

Your order is not accepted until payment has been successfully processed and Vaniksha Organics issues an official order confirmation or dispatch notification. In the event that we modify or cancel an order, we will attempt to notify you by contacting the email address, billing address, or phone number provided at checkout.

You represent and warrant that your purchases are strictly for your own personal or household consumption and not for unauthorized commercial resale, gray-market distribution, or unapproved commercial re-export. Purchases are subject to return or exchange solely in accordance with our Refund Policy.

SECTION 4 - PRICES, TAXES AND BILLING

  • Pricing & Currency: Domestic transactions are displayed and settled in Indian National Rupees (INR ₹). For international orders, prices may be converted based on prevailing foreign exchange rates applied by your issuing bank or payment gateway. Product prices on the Platform are inclusive of applicable Goods and Services Tax (GST) in India, unless explicitly stated otherwise.

  • Price Changes: Prices, discounts, and promotional campaigns are subject to change without notice. The price charged will be the price in effect when the order is placed, as reflected in your order confirmation. Posted product prices do not include shipping fees, courier handling, or international customs charges unless explicitly qualified.

  • Promotions: Promotional voucher codes, free shipping thresholds (e.g., free shipping on orders above ₹700), or special offers cannot be combined unless explicitly stated, and may be modified or revoked at our discretion.

  • Payment Accuracy: You agree to provide current, complete, and accurate purchase, payment, and billing information for all orders. You represent and warrant that:

    1. The payment details you provide are true, correct, and complete.

    2. You are duly authorized to use the designated payment instrument (UPI, Credit/Debit Card, Netbanking, or digital wallet).

    3. Charges incurred will be honored by your financial institution.

    4. You will pay the total charges incurred, including product prices, shipping fees, and applicable taxes.

SECTION 5 - SHIPPING, LOGISTICS & CROSS-BORDER DELIVERY

  • Domestic Fulfillment: Orders within India are dispatched through integrated third-party logistics partners (such as Shiprocket courier networks) from our fulfillment hubs in Karnataka (Bangalore) and Bihar (Kahalgaon). Standard dispatch typically occurs within 24 to 48 business hours of order placement.

  • Delivery Estimates: Stated transit times (e.g., 2–5 business days for standard delivery, 24–48 hours for Priority Express Air) are operational estimates and are not absolute guarantees. We are not liable for delays caused by severe weather, regional transport disruptions, festive courier backlogs, or events outside our reasonable control.

  • Title & Risk of Loss: Once an order is handed over to the courier partner and an Air Waybill (AWB) or tracking number is generated, title and risk of loss pass to the customer.

  • International Orders & Customs (DDU / DAP): For shipments dispatched outside India:

    • Customers are solely responsible for ensuring that the purchased food products comply with the local import laws, agricultural clearances, and customs regulations of the destination country.

    • Unless explicitly included at checkout, international orders are fulfilled on a Delivery Duty Unpaid (DDU) / Delivered at Place (DAP) basis. Any import tariffs, customs processing fees, value-added taxes (VAT), or clearance charges assessed by the destination customs authority are the exclusive obligation of the recipient.

    • In the event a parcel is delayed, refused, returned, or confiscated by destination customs due to non-payment of local import taxes, regulatory restrictions, or failure to collect the shipment, Vaniksha Organics shall not be liable to issue refunds for goods or courier expenses incurred.

SECTION 6 - CANCELLATIONS, PERISHABLE RETURNS & DAMAGE PROTOCOL

  • Order Cancellations: Orders may only be cancelled prior to warehouse processing and fulfillment. Once an order has been packed and an AWB/tracking number has been generated with our logistics partner, cancellation is no longer possible.

  • Perishable Nature & Non-Returnable Goods: In accordance with food safety, hygiene protocols, and consumer protection guidelines, all food, snack, and pantry products are non-returnable and non-exchangeable once delivered, unless the item arrives in a visibly damaged, broken, or spoiled condition.

  • Damage & Missing Items Protocol:

    • If a consignment arrives tampered with, crushed, or contains missing items, you must notify our customer support team at care@vanikshaorganics.com within 48 hours of recorded delivery.

    • To validate a claim, you must provide clear photographs or an unboxing video showing the outer shipping box with the courier label intact, along with the affected product and batch details.

    • Damage claims reported after 48 hours of confirmed delivery will not be eligible for replacement or credit.

SECTION 7 - INTELLECTUAL PROPERTY RIGHTS

Our Services—including all trademarks, brand names ("Vaniksha Organics"), logos, packaging designs, proprietary narratives (including "Our Roots"), product descriptions, imagery, graphic assets, videos, website code, and layout architecture—are the proprietary intellectual property of Vaniksha Organics or licensed to us, protected under Indian and international copyright, trademark, and intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, duplicate, distribute, modify, create derivative works of, publicly display, republish, download, store, sell, or exploit any portion of our trademarks, design systems, or proprietary content without express prior written consent from Vaniksha Organics. Unauthorized use of any brand asset constitutes a violation of applicable intellectual property statutes.

SECTION 8 - OPTIONAL THIRD-PARTY TOOLS

We may provide you with access to third-party tools (such as shipping calculators, address auto-completers, or order tracking modules) that we neither monitor nor have direct operational control over.

You acknowledge and agree that we provide access to such tools on an "as is" and "as available" basis without warranties, representations, or endorsements of any kind. Vaniksha Organics shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools available through the Platform is entirely at your own risk, and you must review the terms governing those third-party services.

Certain content, products, and services available via our Platform may include materials or links directing you to third-party websites or services (including courier tracking portals or external review platforms). We are not responsible for examining or evaluating the accuracy of third-party materials, and we do not assume liability for any materials, websites, products, or services of third parties.

Please carefully review the policies and practices of third parties before engaging in any transaction. Inquiries, complaints, or claims regarding third-party platforms should be directed to the applicable third party.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Vaniksha Organics is hosted on the Shopify e-commerce platform, which provides us with the infrastructure to deliver our Services to you. However, all commercial transactions, product representations, and sales made on this Platform are conducted directly between you and Vaniksha Organics.

By using our Services, you acknowledge and agree that Shopify Inc. is not responsible for any aspect of sales between you and Vaniksha Organics, including product quality, order fulfillment, delivery transit, or customer service. You hereby expressly release Shopify and its affiliates from all claims, damages, liabilities, and causes of action arising from or related to your transactions with Vaniksha Organics.

SECTION 11 - PRIVACY POLICY & DATA PROCESSING

Vaniksha Organics does not store, record, or retain complete credit card numbers, debit card numbers, CVVs, or UPI PINs. All financial interactions are encrypted and processed through certified third-party payment gateways (e.g., Razorpay, Cashfree, PhonePe PG, PayPal) meeting PCI-DSS standards.

SECTION 12 - CUSTOMER FEEDBACK & USER REVIEWS

If you submit, post, email, or transmit reviews, feedback, culinary suggestions, or other content (collectively, "Feedback"), you grant Vaniksha Organics a perpetual, worldwide, non-exclusive, royalty-free, and sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback in any marketing, digital, or print media for commercial and brand promotional purposes.

You represent and warrant that your Feedback:

  1. Does not infringe upon the intellectual property, privacy, or personal rights of any third party.

  2. Does not contain defamatory, unlawful, obscene, threatening, or abusive content.

  3. Does not contain software viruses, commercial spam, or deceptive statements.

We reserve the right, but have no obligation, to review, edit, or remove user reviews or Feedback that violate these Terms.

SECTION 13 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, ingredient specifications, pricing, promotions, shipping fees, transit estimates, or stock availability.

In the event of a cancellation resulting from an error, any collected payment will be refunded to the original payment source.

SECTION 15 - AUTOMATED AGENTS & CRAWLER PROTOCOL

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE ENTIRELY UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. CULINARY, STORAGE, AND PREPARATION SUGGESTIONS PROVIDED ON THE PLATFORM ARE FOR INFORMATIONAL PURPOSES ONLY.

SECTION 18 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VANIKSHA ORGANICS, ITS FOUNDERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS (OR SHOPIFY INC. AND ITS AFFILIATES) BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, ARISING FROM YOUR USE OF THE SERVICES, DELAYS IN TRANSIT BY THIRD-PARTY COURIERS, CUSTOMS ACTIONS, OR ANY ALLERGIC REACTIONS RESULTING FROM NON-ADHERENCE TO PRINTED PRODUCT INGREDIENT STATEMENTS.

IN ANY EVENT, THE TOTAL AGGREGATE LIABILITY OF VANIKSHA ORGANICS FOR ANY CLAIM ARISING OUT OF OR RELATING TO A SPECIFIC PRODUCT PURCHASE SHALL BE STRICTLY LIMITED TO THE ACTUAL AMOUNT PAID BY THE CUSTOMER FOR THAT DISPUTED PRODUCT.

SECTION 19 - INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Vaniksha Organics, Shopify Inc., and our respective founders, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, liabilities, claims, damages, demands, and reasonable legal fees asserted by any third party arising out of:

  2. Your violation of any applicable law or the rights of a third party.

  3. Your unauthorized use, misuse, or resale of products procured via the Platform.
